Who Issues an EIA Certificate in Tanzania: NEMC Administers; The Act Names the Issuer

Direct answer

Who Issues an EIA Certificate in Tanzania? NEMC is the Council that screens projects, reviews environmental impact statements and keeps the process moving. It is not automatically the person who issues the EIA certificate. Under the Environmental Management Act framework, the certificate is issued by the authority the Act names, commonly described in practitioner material as the Minister responsible for environment after NEMC’s recommendation. This page does not invent a section number. Confirm the live Act text and the certificate you are actually holding. A NEMC correspondence, a screening decision, or a consultant’s ‘approval’ is not the certificate.

This page is the issuer file: NEMC runs the process; the Environmental Management Act framework names who issues the EIA certificate. It is not the ‘when required’ list: that is the sibling page.

As at 10 September 2026. Confirm the live Act text and the certificate in hand. This page invents no section number and no fee.

The usual confusion

Officers, consultants and lenders say ‘NEMC approval’ as shorthand. NEMC is the National Environment Management Council. It screens, reviews environmental impact statements, and administers the process. Practitioner material and the EMA framework commonly describe the certificate as issued by the Minister responsible for environment (or the authority the live Act names) after NEMC’s recommendation. Shorthand is how files are mislabelled. Read the signature block on the paper you hold.

PaperTypical roleTreat as the certificate?
Screening decision / registration acknowledgementProcess startNo
NEMC review comments / correspondenceReviewNo
Consultant’s ‘approval’ emailNot a public instrumentNo
EIA certificate under the ActThe decision instrumentYes: if it is that instrument

Why the distinction matters

Banks, TISEZA, municipal building desks and EWURA will ask for the certificate. A NEMC letter that says the study was received is not that certificate. Conditions on the real certificate (monitoring, offsets, stack limits) bind the operator. Conditions in a consultant PowerPoint do not.

What to do with the paper you have

  1. Read the title: does it say certificate?
  2. Read the signatory: Council, Minister, or someone else?
  3. Read the conditions and the expiry / review line if any.
  4. If it is correspondence, go back to NEMC and ask where the certificate is in the process.
  5. Do not start construction on a review letter.

Sequence relative to other files

The trigger page decides whether you need this instrument at all. The issuer page decides when you may honestly tell a lender you ‘have EIA’. Building permits, sector licences and land instruments remain separate. Hydropower and other energy files on this site already warn that EWURA is not NEMC.

GN 487A

Irrelevant to the signature block. Reserved classes are licensing. This page is environmental decision-making.

Where this file stalls

Currency of this file

EMA regulations and delegation practice can move. This page is the issuer distinction as at 10 September 2026. The live Act and the signature block win.

Worked path: reading a real paper

If the document is headed as a certificate, names the project, names the proponent, lists conditions, and is signed by the authority the live Act names, you may have the instrument. If it is a letter thanking you for submitting terms of reference, you have correspondence. Put both in the file. Tell the lender the truth about which one you have.

If the signatory is a consultant, you have a private paper. If the signatory is a municipal environmental officer, you may have a different local instrument, still not automatically the EIA certificate. Confirm NEMC’s register where one exists.

Conditions are the operating system

Certificates bind. Monitoring, reporting, stack limits, offset planting, and audit cycles, where printed, are duties. Breaching conditions is how a later expansion is refused. Assign an owner in the company. Do not leave conditions in the lawyer’s PDF graveyard.

Language and certified copies

Lenders will ask for certified copies. Confirm how NEMC or the issuing office certifies. A colour scan from WhatsApp is not a certified copy. Budget the errand.

How to brief a lender without lying

Write: ‘NEMC screening registered on [date]. Environmental impact statement submitted on [date]. Certificate under the EMA framework issued on [date] by [signatory as printed], copy attached.’ If any date is missing, say it is missing. ‘We have NEMC approval’ is the sentence that later becomes a drawdown dispute.

If the project changed after the certificate (capacity, location, process) write that too. Variation is a process. Silence is a condition breach waiting for an audit.

What this page is not

A substitute for the Act. A NEMC org chart. A municipal environmental-permit manual. It is one distinction: administering Council versus issuing authority. Get that distinction right and the rest of the environmental file becomes readable.

What NEMC actually does, in operator language

The National Environment Management Council receives the project, administers screening, reviews the environmental impact statement, may inspect, and keeps the process on a clock the live regulations describe. Officers you meet at NEMC are running that machine. They are not, on the usual reading of the EMA framework, automatically the person whose name must appear as the issuing authority on the certificate. Practitioner material commonly describes a ministerial issuance after the Council’s recommendation. Confirm the live Act. If a later amendment moved the signature, the amendment wins and this paragraph yields.

Calling every NEMC letter ‘the certificate’ is how a construction start date is set on a document that cannot bear it. Train the project controls person to reject the shorthand. The paper is either the certificate or it is not. There is no third state called ‘NEMC said it is fine’.

Municipal, sector and lender papers that are still not the certificate

A municipal environmental health permit, a waste-effluent permit, an EWURA licence, a Mining Commission certificate, or a lender’s environmental and social action plan can all be real. None of them is the EIA certificate unless the paper is the EIA certificate. Stack them. Do not substitute them. The trigger page decides whether you need the EIA instrument. This page decides which signature counts as having it.

If a municipal desk issues a building permit on the strength of a NEMC acknowledgement, you may have a municipal problem and an environmental problem. The building-permit orientation is the construction file. Do not start pouring because one desk was fast.

Amendments, transfers and the name on the certificate

The proponent named on the certificate should be the legal person that will build. A BRELA company that is not the named proponent is a transfer or variation file, not a re-label. Confirm the live transfer practice. Do not ‘novate’ the certificate in a share-purchase agreement and assume NEMC has been told. The Act’s machine has to move.

Capacity increases, process changes and location shifts are the usual reasons a beautiful certificate becomes the wrong paper. Read the conditions. If the condition says the project is as described in the statement, and the statement said fifty tonnes, five hundred tonnes is a new story. Ask before the EPC change-order is signed.

As-at 10 September 2026: read the signature block aloud

In the project controls meeting, read the title of the paper and the signatory aloud. If the room cannot say ‘this is the EIA certificate issued by [authority named on the paper]’, you do not have it yet. Shorthand ends in that meeting. Lenders should hear the same sentence that the file uses.

Store a certified copy, not only a WhatsApp scan. Confirm how the issuing office certifies. Conditions get an owner in the company with a calendar. Unowned conditions are how the next expansion is refused.

What a declined lender pack usually looked like

A NEMC acknowledgement, a consultant letter, and a slide titled ‘EIA approved’. None of those is the certificate. Put the certificate in the data room or write ‘not yet issued’ on the checklist. The honest gap is financeable. The slogan is not.

Hydropower and mining files already make this distinction

The hydropower foreign-contractor orientation on this site already warns that EWURA is not NEMC. Mining keepers already warn that a mineral right is not an EIA certificate. This page is the signature-block version of those warnings. Do not edit those keepers from this assignment. Cross-read them. If a sentence here disagrees with a live hydropower or mining page on GN 487A hedging, those pages’ hedge stands and this page yields.

Energy generation, mines and factories still need the certificate where the list requires one. The issuer does not change because the sector regulator is louder. EWURA, the Mining Commission and a municipal building desk can all demand to see the paper. They do not issue it.

Frequently asked questions

Does NEMC issue EIA certificates in Tanzania?

NEMC administers screening and review. The EMA framework names the issuer of the certificate, commonly described as the Minister responsible for environment after recommendation. Confirm the live Act and the paper in hand.

Is a NEMC letter the certificate?

Usually no. Read the title and the signatory.

Can I start building after NEMC says the study was received?

Not on that basis alone. You need the certificate the Act names, if the project required one.

Where do I confirm this?

nemc.go.tz and the live EMA text. Confirm the certificate you hold.

Does this apply to audits after the certificate?

Audits are a different instrument. See environmental-audit orientation if upgraded; they do not replace a missing certificate.
