When an EIA Is Required in Tanzania? An environmental impact assessment in Tanzania is required when the project falls in a type that the Environmental Management Act framework and the live NEMC project lists treat as EIA-mandatory, or when screening says a full study is needed. A preliminary environmental assessment, an audit, or a permit for effluent is not a substitute for an EIA certificate where the list requires one. NEMC administers the process. The list decides, not the slogan
Tanzania’s Environmental Management Act framework, administered in practice through NEMC, treats some projects as requiring a full environmental impact assessment, some as requiring a preliminary assessment or screening, and some as needing other instruments (audits, permits to emit or discharge). Investors who skip straight to ‘we will plant trees’ still meet the list. Open the live NEMC categorisation for the activity (factory, mine, hotel, dam, waste plant) before you sign the EPC.

Typical triggers, without inventing the schedule
Orientation only: large manufacturing, mining and processing, energy generation, large-scale agriculture and irrigation, tourism facilities in sensitive locations, and waste-management plants commonly appear on EIA-mandatory or screening lists in Tanzanian practice. Small offices in existing buildings often do not. Your project is not ‘small’ because the investor says so. Confirm the live list. If screening says full EIA, budget the study and the calendar before you pour.
Consultants, TOR and public participation
EIA work is done by registered environmental experts under the live NEMC rules. Terms of reference, public meetings where required, and the review clock are process, not decoration. A foreign ESIA written for an IFC lender is useful evidence. It is not automatically the Tanzanian instrument. Map the lender study onto NEMC’s form.
Other permits still sit beside the EIA
A certificate does not replace a building permit, an EWURA licence, a mining licence, or a land instrument. Sequence the files. Pouring concrete during ‘pending EIA’ is the usual expensive photograph.

Reserved business classes are a licensing Order. EIA is environmental. You can be allowed to own the activity and still need the study. Screen both.

Worked path: office fit-out vs factory vs mine
Fitting out an existing Dar office for a consultancy is often not an EIA-mandatory project. Confirm the live list anyway if you are changing use or adding a generator farm the list cares about.
A new factory with boilers, effluent and a greenfield plot is the other end. Screening will not save you from a full study if the list says EIA. Budget the expert, the public meeting if required, and the calendar before the EPC ‘commencement’ date.
A mine is a Mining Commission file and an environmental file. The mineral right is not the EIA certificate. The EIA certificate is not the mineral right. Sequence both. STAMICO and private-right choices live on the mining keepers this assignment must not rewrite.
Expansions and variations
A certificate for a 50-tonne line does not automatically cover a 500-tonne line. Confirm variation and amendment practice with NEMC before the expansion capex. Do not treat last year’s certificate as a blanket.
Lenders and Equator Principles
Lender ESIA is a banking product. Tanzanian EIA is a statutory product. Map one onto the other. Do not skip NEMC because the lender workshop went well.
Documents the NEMC file usually needs
Orientation: project description with capacities and coordinates; land instrument or a credible path to one; company identity; terms of reference the live process requires; the study prepared by a registered expert; public-meeting records where required; and later, the certificate. Lender ESIA can be an annex. It is not the cover sheet.
Water, power and waste stories belong in the project description. A factory that ‘will connect later’ still has an effluent question. Pretending the plot has no drainage is how screening becomes a full study on the second visit.
What this page is not
A who-signs-the-certificate essay: that is the companion. A NEMC fee table. A mining-licence manual. A promise that planting trees replaces a listed EIA. It is the trigger: list, screening, study, certificate, then the other permits.
How to read a project list without pretending this page is the Gazette
NEMC and the EMA framework publish types of projects that need a full environmental impact assessment, types that may need a preliminary assessment, and types that may be screened into a lighter instrument. The list moves. This page will not reprint it. Open nemc.go.tz, find the live project classification, and match your capacity, process and location to a row. If you cannot find yourself, ask NEMC in writing. Guessing ‘we are small’ is not a classification.
Location matters as much as capacity. A modest plant next to a water source or in a sensitive area can be treated more strictly than a larger plant on an already industrial plot. The list is not only a tonne-per-day table. Read the location rows. Confirm with the registered expert you will actually hire, and then confirm with NEMC, because the expert is not the Council.
Registered experts, not the founder’s cousin
Studies are prepared by experts the live NEMC register recognises. A foreign ESIA boutique that is not on that register may write a lender document. It does not, by itself, write the Tanzanian EIA. Pair them if you must. Do not skip the registered expert because the lender’s consultant used prettier maps.
Terms of reference, where the live process requires them, are a gate. Starting the study before the terms are agreed is how you pay twice. Confirm the live sequence on nemc.go.tz. This page invents no day-count.
Public meetings, comments, and the file you keep
Where the process requires public participation, the attendance list, the notices, and the responses to comments are part of the file. A meeting held only in English in a Swahili-speaking ward is a later objection waiting to happen. Follow the live notice rules. Photograph the notices. Keep the signed list. This is not decoration.
After the certificate, monitoring and audit duties can exist. The audits-after-EIA slug remains pruned on this assignment unless it is upgraded separately. Do not treat the certificate as the last environmental paper you will ever hold.
As-at 10 September 2026: list first, concrete later
Do not pour a slab, cut a road, or mobilise an EPC contractor on the theory that ‘we will EIA in parallel’. Where the live list requires a certificate before construction, parallel is a breach. Confirm nemc.go.tz. Budget the study in the financial close timetable, not as a surprise in month six.
If screening is the live first step, do screening. Do not skip it because a cousin’s factory ‘never needed one’. Cousin’s factory is not a classification. Your HS process, capacity and coordinates are.
