Change of Land Use in Tanzania: Planning Consent, Not a New Title

architecture model: Change of Land Use in Tanzania
An architecture model: change of use is planning consent, not a new company. Caption date: 10 September 2026. A photograph is not a filing.
Direct answer

Does a new company or a TISEZA letter change the use of Mainland land? No. Changing the approved use is a planning consent under the Urban Planning Act, Cap. 355, administered by the local government authority that owns the planning scheme, plus the land administration that issued the Certificate of Occupancy or derivative right under the Land Act, Cap. 113. The occupancy already states a use. Building without matching that use is how stop-orders start. Village land, general land and reserved land are different tracks. Confirm lands.go.tz and the local authority. This page publishes no application fee.

This page is the change-of-use operating file: planning consent, then the occupancy endorsement, then the building permit if you will actually build. It is not a first-title tutorial, not a village-land conversion manual, and not a TISEZA site-selection slide.

As at 10 September 2026. Confirm the local planning authority and the Ministry of Lands. Zanzibar land is a different statute.

The occupancy already names a use

A Certificate of Occupancy is not a blank canvas. It states a use: residential, commercial, industrial, agricultural, or as the title actually prints. Operating a factory on a residential occupancy, or a lodge on agricultural land, is not a “TISEZA project.” It is a planning breach. The local authority’s scheme, the occupancy, and the building permit have to describe the same activity.

A derivative right or a granted right of occupancy to an investment vehicle still carries a use. Changing the use is not a new title. It is consent, then an endorsement or a fresh condition, as the live land office names it. Do not surrender a good title to “start again” unless the land office told you to.

NEMC sits beside the file when the new use triggers an EIA. A change from residential to a fuel station is not only a planning tick. The EIA sibling page is the overlay. Do not treat a planning consent as an environmental certificate.

Sequence

  1. Read the occupancy. Write the use it actually prints, not the use in the SPA recital.
  2. Read the local planning scheme for the plot. If the scheme forbids the new use, stop. Rezoning is a different, slower political file.
  3. Apply for planning consent in the form the local authority currently publishes.
  4. Take the land-office endorsement the occupancy needs. A planning letter in a drawer is not an endorsed title.
  5. Then the building permit, then construction. Reverse order is a stop-order.
  6. If the land is village land, do not start at the municipal counter. Start at the village-land track.

Worked path: the warehouse on a residential plot

A buyer takes a Dar plot with a residential occupancy because the shed at the back “already looks like a go-down.” Planning has not consented. The occupancy has not been endorsed. A building permit for a warehouse will bounce. Neighbours will complain. The inspector will not care that TISEZA registered the company. Consent, endorse, then use.

A different stall: a foreign investor is told a change of use “cleans” a village-land problem. It does not. Village land, general land and reserved land are different tracks. The occupancy-versus-derivative page is the sibling.

Foreigners, occupancy and the derivative right

A change of use does not upgrade a foreigner’s land tenure. If the live Land Act still requires a derivative right rather than a granted right of occupancy for the investor’s nationality, planning consent will not mint a better title. Read the occupancy-versus-derivative sibling before you spend on architects. A TISEZA certificate does not rewrite Cap. 113.

What “pending” looks like on a site

Hoardings, foundations and a marketing suite built while planning is pending are how stop-orders are photographed. Lenders who take a charge over a plot whose use does not match the intended development are taking a planning risk, not only a title risk. Put the consent letter and the endorsed occupancy in the security pack. A lawyer’s opinion that “it should be fine” is not an endorsement.

Not on this page’s authority. Reverse order is a stop-order.

Village land?

Different track. Do not start at a Dar municipal form.
