Mainland vs Zanzibar Land Rights? Foreign investors do not hold Mainland and Zanzibar land on the same statute. On the Mainland, typical investment use is a derivative right or a lease sitting on general land after any village-land conversion, often coordinated with TISEZA land facilitation. Zanzibar administers land under its own tenure framework; ZIPA and the Zanzibar land desks are the orientation doors, not BRELA and not a Mainland certificate of occupancy. The Union does not unify title

Company law splits at BRELA / BPRA. Land splits harder. Mainland general land, village land and reserved land are Land Act / Village Land Act categories. Zanzibar’s land tenure, grants and leases are administered under Zanzibar instruments. Pasting a Mainland ‘foreigners take derivative rights’ sentence onto a Nungwi hotel file is how the first search returns the wrong statute.

Mainland: derivative rights as typical investment use

On the Mainland, TISEZA and Lands orientation describe granted occupancy as associated with citizens or qualifying holders, and derivative rights as the usual non-citizen investment route, after village land, if that is the category, has been converted to general land. See the instrument page. TISEZA facilitation does not skip conversion and does not reprint a Zanzibar grant.

Zanzibar: different desks, different paper

Hotel, tourism and industrial land in Unguja and Pemba is a Zanzibar file. ZIPA may coordinate investment land. It does not replace the Zanzibar land authority’s grant or lease. A Mainland certificate of occupancy in a Dar company is not a Zanzibar title. Confirm the live ZIPA land guidance and the Zanzibar land desk for the parcel. People still need permits on that side

Holding land does not authorise the foreign director to work. Mainland work and residence remain Labour and Immigration files. Zanzibar has its own permit desks. Mixing them is the sister stall to mixing title.

GN 487A does not replace land law

Reserved business activities are a licensing Order reported for the Mainland. Land eligibility is a tenure question. You can be allowed to hold a derivative right and still be unable to run a reserved shop on it. Screen both.

  3. Match the company: BRELA or BPRA, to that side.
  4. Match the investment desk: TISEZA or ZIPA, if facilitation is in play.

Worked path: Mainland factory vs Zanzibar hotel

Kwala or an Eastern Zone park is a Mainland parcel. Expect the Land Act stack, possible TISEZA facilitation, and a BRELA company as the usual holder. Confirm the extract. Zanzibar ZIPA language on the brochure does not apply.

A beach hotel in Unguja is a Zanzibar parcel. Expect Zanzibar tenure paper, ZIPA if the project is an investment ZIPA receives, and a BPRA company as the usual holder. A Dar advocate’s template derivative-right deed is the wrong instrument until a Zanzibar desk says otherwise in writing.

Projects that straddle the Union in the investor’s head (‘Mainland processing, Zanzibar tourism lodge’) are two land files. Budget two searches, two companies, two investment desks if facilitation is used.

Surveyors and the wrong statute

A competent surveyor still needs the right law. Ask which register they searched. If the answer is ‘Tanzania’ without Mainland or Zanzibar, hire a different surveyor.

Mortgages and the split

Banks take security over the instrument you actually hold in the jurisdiction that issued it. A Mainland charge does not, by magic, cover a Zanzibar lease. Confirm the bank’s security counsel on that side of the Union.

Tourism land in Zanzibar often collides with beach setbacks, environmental screening, and hotel licensing. Those are not Mainland TALA photocopies. Confirm the live Zanzibar desks. A beautiful concept note is not a setback waiver.

Village land exists on the Mainland in a way investors keep missing

Much of the attractive ‘greenfield’ an agent shows outside a Mainland town is village land until conversion. Conversion is a statutory path, not a handshake with a chairman. The village-land keeper on this site is the conversion file. This page only needs one sentence: a Zanzibar beach plot is not converted through the Mainland Village Land Act, and a Mainland village allocation is not titled by ZIPA. Put the parcel on the correct statute before you pay anyone.

Compensation, allocation minutes, and village assembly stories belong on the Mainland conversion file. Pasting them onto a Zanzibar parcel because ‘Africa land is communal’ is how you invent a law. Confirm the live Zanzibar tenure text for that island.

Foreigners and the word ‘own’

Investors say ‘we will own the land’. On the Mainland, the operating words are right of occupancy, derivative right, and lease. In Zanzibar, the operating words are the grants and leases the Zanzibar statutes actually issue. English freehold is a UK story. Do not put ‘freehold’ in a term sheet for either geography unless an advocate has read the live instrument and used that word on purpose. This desk will not.

A citizen spouse, a citizen nominee, or a local company with foreign control does not magically convert the land statute. Nominees are a beneficial-ownership and GN 487A problem as well as a land problem. Screen all three.

Building and environmental files still split

A Mainland building permit does not authorise a Zanzibar hotel. A Zanzibar environmental screening does not satisfy a Mainland NEMC list. EIA orientation is a sibling pair on this site. Attach the environmental file to the same geography as the land file. Mixing them is how a lender is shown two half-approvals and no complete plot.

As-at 10 September 2026: two searches, two companies

If the board minutes describe a ‘Tanzania land bank’ with plots on both sides of the Union, split the minutes. One Mainland search, one Zanzibar search, two legal persons unless an advocate has designed a holding structure that still files twice where the law requires it. A single search PDF labelled ‘East Africa’ is not a title.

Confirm lands.go.tz for Mainland extracts and the live Zanzibar land desk for island parcels. ZIPA and TISEZA are facilitation doors, not registers that replace those extracts.

What a declined land pack usually looked like

A Mainland derivative-right template dropped onto an Unguja parcel, or a Zanzibar offer letter dropped into a TISEZA Mainland file. Geography first. Instrument second. Facilitation third. If those three are not in that order, the pack is not ready for a deposit.
