Working in Tanzania Without a Permit: The File Breaks Before the Slogan Does

This page is the unauthorised-work operating file: what breaks when a non-citizen works in Mainland Tanzania without the live Labour and Immigration stack. It is not the permit-application keeper, that already exists, and it publishes no fine, no jail term, and no invented section.

Visitor stamps are not work

A tourist visa, a business visitor visa, and a work permit are different instruments. Attending a meeting is not installing a plant. ‘I will just supervise for six weeks’ is work if it is work. Immigration officers and, later, banks and landlords, read conduct, not the slogan on the landing card.

Remote work for a foreign employer while sitting in a Dar Airbnb is a live Immigration conversation, not a Twitter exemption. Confirm the live rule. This page will not invent a digital-nomad class Tanzania has not named on a primary notice this desk has confirmed.

The employer is in the file

The company that put the person on a site, a payroll, a WhatsApp group labelled ‘temporary cover’, or a client-facing email is the employer Immigration and Labour will ask. Directors who ‘didn’t know’ still signed the lease. A labour-hire story does not automatically move the duty. Confirm the live Non-Citizens Public Service / labour-and-employment framework that actually applies to private employers, and do not cite a public-service Act as if it were a factory manual.

Payroll without a permit is how TRA and NSSF/WCF meet Immigration in the same season. Do not ‘keep them off payroll to be safe’. Off-payroll work is still work.

What actually breaks first

Statutory consequences (fines, removal, company exposure) exist. Read the live Immigration Act framework and the labour instruments. Quoting a 2015 WhatsApp figure here would be a disservice. Confirm.

Zanzibar is not a loophole

A Mainland permit does not authorise work in Zanzibar. A Zanzibar authorisation does not authorise work in Mwanza. Hopping islands on a visitor stamp to ‘help the hotel open’ is the same file with a prettier backdrop. ZIPA facilitation is not a work permit.

Sequence to get out of the stall

1. Stop the person working until the live instruments exist, or accept that you are choosing the breach.
2. Form or identify the employer on the correct side of the Union.
3. File the work permit through OWAIS / epermit.kazi.go.tz as the live process requires.
4. File the residence permit with Immigration.
5. Then put them on the site and the payroll: not before.

Worked path: commissioning engineer vs ‘the cousin will manage’

A foreign OEM sending an engineer to commission a machine is still work. Budget the permit in the EPC timetable. Some site work has live class and duration overlays. Confirm Labour, do not invent a 90-day exemption from a forum. If the live process has a short-term class, use it. If it does not, do not pretend.

A founder putting a cousin in the Dar office on a visitor visa to ‘watch the shop’ is the textbook breach. The shop can wait. The permit cannot.

Documents that show the person is allowed to work

Live work permit; live residence permit; passport bio page; the employer’s extract; and the contract that matches the role. A lodging receipt for an application is not a permit. A TISEZA certificate is not a permit. A visitor stamp is not a permit.

Site gate passes should copy the permit, not the landing card. Mining and energy clients already know this. Factories learn it when Immigration visits.

Failure modes

Starting work the day OWAIS accepts the upload. Dependent passes used as work. Class A investor permits used to staff operations. Off-payroll ‘consultants’ who sit in the office every day. Zanzibar work on a Mainland permit.

As-at 10 September 2026: diary discipline

Budget permits in the EPC or opening timetable at contract signature. If the machine cannot wait, the permit still can. The consequences page is not a risk register you choose.

Mandate-holders this file does not replace

Labour owns the work permit. Immigration owns stay. The employer owns the decision to put the person on a site. TRA owns PAYE if they are paid. Sector sites own gate passes. TISEZA and ZIPA own none of this. A facilitation certificate is not a defence at the airport.

What to put in the board minutes

Write that no non-citizen starts work until both live instruments exist, that visitor visas are not a bridge, and that off-payroll status is not a defence. If a director wants an exception for ‘just two weeks’, minute the refusal. Unminuted exceptions are how companies meet Immigration without a story.

When a person is already working, minute that work stops pending advice. Continuing while you ‘regularise’ is a choice. Write it as a choice if you make it.

What a declined regularisation pack usually looked like

A person already on site, an OWAIS upload dated this morning, and a visitor stamp offered to a bank as a permit. Work does not become lawful because the portal accepted a PDF. Stop the work, file the live instruments, then restart. Off-payroll status is not a defence. A Mainland permit is not a Zanzibar defence. This page still prints no fine.

Operator calendar for a foreign hire

At offer: no start date before live instruments. Week of filing: OWAIS and Immigration as the live process requires. After grant: site and payroll. Not before.
