Overlapping Mineral Claims in Tanzania: The Commission’s Cadastre, Not a Lawyer’s Overlay

Who actually holds overlapping mineral ground in Tanzania? The Mining Commission’s cadastre under the Mining Act, Cap. 123 (Revised Edition 2019), not a consultant KML, a STAMICO booklet, or a TISEZA slide. The register names the holder, the class (prospecting licence, primary mining licence, mining licence or special mining licence) the coordinates, and the remaining term. A dealer or broker class grants no ground. Surface title under the Land Act is not a mineral right. Priority among competing applications is the live mineral-rights procedure the Commission administers; this page does not freeze a first-come day-count. Confirm tumemadini.go.tz the week you diligence.
This page is the cadastre-priority operating file: what to do when two mineral stories sit on the same coordinates. It is not a first-time licence tutorial, not a dealer-class walkthrough, and not a restatement of the locked STAMICO entry-route page.
- Licence classes: mining licences explained
- Renewal and transfer: Commission continuity
- Gemstone versus gold dealing: different Commission classes
- STAMICO versus a private right: 2026 operating choice
Law is stated as at 10 September 2026. The English consolidation used here is the Mining Act, Cap. 123, Revised Edition 2019, as administered by the Mining Commission. Regulations and portal field names move. If a sentence here disagrees with the live Act, the live mineral-rights regulations, or a Commission circular, the Commission wins.
The cadastre is the right: GIS is discovery
Consultants overlay KMLs. Advocates overlay title deeds. Neither overlay is the mineral right. The Commission’s mining cadastre, the live electronic register and the paper certificate it still issues, is what an inspector opens. If your polygon is pretty and the register is empty, you do not hold the ground. If the register shows another holder, your overlay is a dispute, not a grant.
Print the cadastre extract the week you diligence, again the week you lodge, and again the week you pay. Coordinates move in conversation. They should not move on the certificate without a Commission instrument. A 2022 consultant map in a data room is discovery. It is not the 10 September 2026 register.
The Ministry of Minerals’ Investor’s Guide Tanzania Mining Sector 2024 is orientation for class and reservation rules. It is not a substitute for a dated cadastre print. The locked STAMICO booklet names licences STAMICO already holds; it does not restamp the cadastre in your name.
Classes that cannot be stacked by a coloured map
| What the print shows | What it is | What it is not |
|---|---|---|
| Two prospecting polygons on the same coordinates | A Commission priority / dispute file under the live mineral-rights rules | A race the later, better-funded buyer automatically wins |
| A prospecting overlay on a live mining licence or special mining licence | Usually an exclusion until the mining right ends, is reduced, or is surrendered | A right to drill “because we applied” |
| A primary mining licence | A class the 2024 guide states foreigners may not hold | A foreign vehicle’s entry door |
| A dealer, broker or export class | A right to trade specified minerals | A pit, a polygon, or a claim |
| A struck-off company still named on the cadastre | A ghost until restoration or a Commission process ends the right | A seller you can take a transfer from this week |
| An expired-looking row | Live until the Commission instrument that ended it is in the pack | Open ground you can fence |
Gemstone exploration and mining are reserved to Tanzanians on the 2024 guide, with ministerial room for a 50/50 joint project where skill, technology or capital requires it. That reservation is a Door-B problem on the STAMICO page. It does not disappear because two polygons overlap. A mineral dealer’s licence requires Tanzanians to hold not less than 25 per cent of the licensed company, with 75 per cent the foreign maximum. That condition does not make a dealing shop a workaround for ground the Client cannot hold.
Surface title is a different statute
A Certificate of Occupancy, a derivative right or a village-land allocation answers who may occupy the surface. It does not answer who holds the minerals. The Mining Act severs those questions. Paying a village for access on ground the cadastre gives to someone else creates a second claimant who will not care about your SPA. Access roads across a neighbour’s polygon are a surface-rights and Commission problem. Do not grade a track to “show presence” during a dispute.
The change-of-use file and the occupancy-versus-derivative file sit on sister pages. Do not paste them here as if a planning consent minted a prospecting licence.
How priority actually gets decided, and what this page will not freeze
The live mineral-rights regulations, not a lawyer’s email, decide how the Commission orders competing applications for the same area and mineral. Historical practice has been to treat valid applications in the order they were received. That is a procedure card, not a slogan this page will freeze as a day-count, a “we were first” screenshot, or a formula a pitch deck can quote. Print the procedure the portal names the week you lodge.
The Commission also hears disputes relating to mineral rights. A private settlement between two applicants is not something an inspector must honour. A community already paid on disputed ground is a second claimant, not a cure. Security contractors posted on overlapping coordinates photograph well for the other side’s inspection file.
Open question, named honestly: whether a pending application is a veto you can ignore, a queue you must wait in, or a grant you can sell depends on the live row the cadastre prints. This page will not invent the answer from a 2019 brochure.
Sequence for a buyer who inherited a coloured map
- Name the coordinates and the class you think you hold or want, not the project nickname.
- Pull the live cadastre print for those coordinates. Save the PDF dated today, with the file name the Commission spelled.
- Name every other holder the print shows, including expired-looking rows. Pull each certificate and each holder’s BRELA extract the same week.
- Read the live dispute and priority path the Act, the regulations and the portal name. Do not invent a “we applied first” email as the path.
- Do not drill, fence, or pay a community as if the overlay were a grant.
- If you still want the ground, the continuity page (renewal or transfer) or a fresh application, whichever the live register actually allows, is the next instrument. A STAMICO conversation is only a door if STAMICO already holds the right.
Worked path: the data room that hid the cadastre
A data room shows a red polygon overlapping a blue one. The seller says “we applied first.” The cadastre shows the blue holder with a live mining licence and the red file as an application. Paying the seller for the red story is paying for a dispute. The Commission will not restamp your SPA. Diligence the register, then price the path the live Act names, or walk.
A different stall: both certificates look live. That is a Commission file, possibly with an advocate. It is not a private settlement the inspector must honour. A third stall: the holder on the cadastre is struck off at BRELA. Restoration sits on its own page. Transferring from a ghost is how the next inspection starts.
A seller who will not let you print the live cadastre in the data room is selling a story. If the deal is “too competitive” to allow a print, it is too competitive to buy.
What to put in the board minutes
Write three dated artefacts, not a narrative. First: the cadastre print with the time and the coordinates as the Commission spelled them. Second: each certificate or application row that touches those coordinates, with class and remaining term as printed. Third: the live procedure card you used that week. A memo that says “we are first” without those three artefacts is a speech. Buyers’ counsel should refuse to close on a speech. Lenders will ask the same four questions: whose name is on the cadastre this week; what class; whether that person is still on the BRELA register; whether anyone is already on the ground.
Failure modes the officer already knows
- GIS overlay treated as a grant
- Drilling while “the overlap is being discussed”
- STAMICO or TISEZA papers offered as cadastre priority
- Buying equity in a holder without a cadastre print from that week
- Invented fees or priority formulas from a pitch deck
- Community payments on disputed ground
- A dealer class treated as a pit

Relinquishment and reduction are Commission instruments
Prospecting licences are reduced and relinquished on a timetable the live regulations name. Ground that has been relinquished can become open. Ground that someone intends to relinquish is not open. Do not drill a neighbour’s remaining block because a geologist said “they’ll drop it next quarter.” Print the cadastre the week you move. A reduction instrument is a document. A rumour is not.

Frequently asked questions
Does a GIS overlay decide who holds the ground?
No. The Mining Commission cadastre and the certificate it issued decide. Confirm tumemadini.go.tz.
We applied first: do we automatically win?
Not on this page’s authority. Read the live mineral-rights procedure. Do not invent a day-count.
Can we drill while the overlap is discussed?
Not on this page’s authority. Drilling on another holder’s live right is how inspections start.
Is STAMICO the cadastre?
No. STAMICO is a possible state-vehicle conversation onto rights it already holds.
Is a land title a mineral right?
No. Occupancy and minerals are different statutes.
Fees?
Not published here. Confirm the Commission. Zatra’s fee is only on /pricing/.
