Tourism Activities Reserved for Citizens: The Mainland Ownership Line

Which tourism classes a non-citizen may not carry on at all, and which are merely conditioned. Caption date: 15 September 2026. A cover is not a filing.
Direct answer

Which tourism activities are reserved for Tanzanian citizens? On the Mainland two instruments close two overlapping lists. The Tourism Act, No. 29 of 2008 reserves mountain guiding, tour guiding, travel agency and car hire for citizens, applied through the Tourist Agents Licensing Authority. GN No. 487A of 2025, published 28 July 2025 under the Business Licensing Act Cap. 208, separately shuts guiding, museums and curio shops, and lets an existing licence run only to expiry. Tour operating, hotels and camps stay open but conditioned on capital and class. Read both Schedules as gazetted before drafting objects.

This page is the Mainland reserved-tourism operating file: the classes a foreign-owned company may not hold whatever its capital, the classes it may hold once conditions are met, and how a desk tests who is really carrying on the business. It is not a licence-class manual and not an island file.

As at 15 September 2026. The Tourism Division of the Ministry of Natural Resources and Tourism owns the tourism reservation; the trade ministry and the district licensing authority own the general-trade side. This file rests on the 2008 Tourism Act and on GN No. 487A of 2025 as gazetted.

Two lists close, and they are not the same list

The reservation is not one rule with one keeper. The Tourism Act reserves named classes for citizens and is administered by the Tourism Division through the body every application form calls TALA. Beside it sits the Business Licensing (Prohibition of Business Activities for Non-Citizens) Order, 2025, barring non-citizens from a gazetted schedule of trades, several of them tourism trades.

A pack the Division accepts can still be refused at the municipal counter, and a certificate issued by an officer who never read the 2025 Schedule repairs nothing. The Minister may add classes by Order.

What each instrument actually closes

The 2008 statute shuts the end of the trade where the earner is a person rather than capital: the mountain, the guide's seat, the agency counter and the hire car.

The 2025 Order shuts guiding inside the country and the running of museums and curio shops. Guiding therefore appears twice, under two statutes, with two enforcement routes. Curio retail appears only in the newer instrument, which is why lodge groups that opened a gate shop are answering questions now.

Tour operating, hotels, lodges, tented camps and the carriage of an operator's own clients sit on neither reserved list. They are conditioned.

Tour operating, hotels, campsNon-citizens admitted, on conditionsTourism Act 2008; Investment Act 2022Reading "not reserved" as "no threshold, no class"

A conditioned class asks for capital, a licence class and evidence. A reserved class asks for nothing: the answer is already no and no amount of equity moves it. Under the Tanzania Investment Act, 2022 the minimum investment capital for a certificate of incentives is USD 500,000 for a foreign investor and USD 50,000 for a Tanzanian one. Tourism carries a separate capital floor for non-citizen operators, taken from the Division rather than inferred.

Citizenship is tested on whoever carries on the business

Incorporation does not naturalise a company. A locally registered company whose shares sit with foreign persons is a non-citizen here, and the beneficial-ownership particulars filed with the registrar put that cap table in front of any officer who looks. The test follows control and benefit, not the place of registration.

The borrowed-name structure is therefore the central risk. A citizen holds the class while a foreign principal funds the vehicles, signs the bank mandate, employs the staff and takes the margin. The 2025 Order reaches both sides of that bargain. Registration cards, the signatory list, payroll and the name on park-entry payments are what an inspection reads, and those four rarely agree with a register drafted to say otherwise.

Zanzibar answers this under its own law

Both instruments are Mainland instruments. Unguja and Pemba license tourism, approve investment and tax non-Union heads through their own statutes and desks: BPRA rather than BRELA for the company, ZRA rather than TRA, and an island authority rather than TALA for the class. A Mainland conclusion carried across the channel is a guess.

The sequence the desks actually follow

  1. Write down the activities, not the ambition. "Safari company" is four or five licensable trades. Split them into guiding, transport, agency, retail and accommodation.
  2. Screen every activity against both Schedules. Anything landing on either list is out of the foreign-owned entity permanently, not until the capital grows.
  3. Decide how the reserved slice is bought. Either from a citizen-owned supplier at arm's length, or left out of the group. No third answer survives inspection.
  4. Incorporate at BRELA with objects that match the split, and file beneficial ownership that matches the real cap table.
  5. Register with TRA for TIN and, where turnover or election requires it, for VAT, before a licence form asks for those numbers.
  6. Apply to the Tourism Division for the class the conditioned activity needs, with capital evidence and the vehicle and premises schedule.
  7. Take the trade licence from the authority for the district where the premises sit.
  8. Close the immigration file last. Permits for expatriate managers, against positions that are not reserved guiding roles.

The pack the file is built from

Certificate of incorporation with memorandum and articles; the beneficial-ownership filing; TIN and any VAT certificate; tax clearance where the licence year demands one; accounts evidencing capital; an inward-transfer advice showing the money arrived through a licensed bank; registration cards for every unit in the fleet schedule; lease or title for the premises; passports, permits and qualifications for named managers; and, for the reserved slice, the supplier's own licence and TIN.

Two papers decide more applications than the rest combined: the shareholding page and the capital evidence, each read against the other. A majority-citizen register beside a bank record showing only foreign inflows invites the question the structure was drawn to avoid.

Illustrative arithmetic: what the reservation costs a lodge group

A foreign-owned lodge group on the northern circuit budgets TZS 1,400,000,000 a year of ground services. Vehicle hire at TZS 520,000,000 and guiding at TZS 180,000,000 fall in reserved classes, so TZS 700,000,000 must be bought from citizen-owned suppliers rather than earned inside the group.

On those payments the group withholds tax on service fees to a resident person at 5% under the Income Tax Act Cap. 332 (TZS 35,000,000 across the year), and remits within seven days after each month end. Where suppliers are VAT-registered, the standard rate of 18% under the Value Added Tax Act Cap. 148 adds TZS 126,000,000, recoverable as input tax only if the group is itself registered and holds proper fiscal receipts. On its own turnover of TZS 3,100,000,000 it pays service levy at 0.3% under the Local Government Finance Act Cap. 290, or TZS 9,300,000, to the district council. Corporate income tax at 30% falls on chargeable income whoever owns the shares. Illustrative arithmetic, not a quotation; confirm the live schedule on tra.go.tz.

TZS 700,000,000 of annual margin leaves the group by operation of law, and a model built before anyone read the reserved list books it in the wrong company.

What the 2025 Order changed

Before it, the tourism reservation rested on the 2008 statute alone and the trade-licensing counter had no separate list of its own to apply. The Order supplied one, and it carries a transition rather than an immediate cut: a non-citizen already trading under a valid licence in a prohibited class runs that licence to its expiry date, with no renewal afterwards. The expiry printed on the existing certificate is therefore the real deadline, and the replacement arrangement has to be standing before it, not assembled after a refusal.

The Tanzania Investment Act, 2022 had already reset the capital thresholds for a certificate of incentives. Relief for nationals of one neighbouring state has since been reported in the press; a report is not a Gazette, and until that relief can be cited by notice number, the Order applies to every non-citizen.

Desks this page does not replace

The Tourism Division and TALA own the tourism class and the reserved list. The district licensing authority owns the trade certificate. BRELA owns the company and the beneficial-ownership register. TRA owns TIN, VAT, withholding and clearance. The Tanzania Investment Centre owns the certificate of incentives. TANAPA, the Ngorongoro Conservation Area Authority and TAWA own park entry, concessions and protected areas; hunting sits under the Wildlife Conservation Act, No. 5 of 2009. Immigration and the labour ministry own permits. Zatra prepares, structures and coordinates the pack across those desks; it issues none of them and assures no outcome.

Frequently asked questions

Can a wholly foreign-owned company hold a tour operator licence on the Mainland?

Yes. Tour operating is conditioned, not reserved. The conditions are the capital floor the Division applies, the licence class, and fleet and premises evidence. Guiding, car hire and travel agency inside the same company get the opposite answer.

Does a residence permit make me a citizen for this rule?

No. Residence is an immigration status. The reservation tests the citizenship of whoever carries on the trade and of those who control and benefit from it. A permit lets you live and work here; it opens no reserved class.

Is an East African Community passport an exemption?

Not by itself. Relief for one neighbouring state's nationals has been reported since gazettement, but a press report is not an instrument. Until it carries a citation of its own, the desk applies the Order.

What happens to a licence a non-citizen already holds in a closed class?

It runs to expiry and is not renewed. Treat that date as the deadline for the replacement arrangement, whether that means a citizen-owned supplier contract or removing the activity from the group altogether.

Can a Tanzanian hold the licence while a foreign investor funds everything?

That arrangement is what the 2025 instrument addresses, and liability attaches to the local nominee as well as the principal directing the trade. Mandates, registration cards and payroll show an inspector who is really trading.

Does GN No. 487A of 2025 apply in Zanzibar?

It is made under a Mainland licensing statute. The islands license tourism and general trade under their own laws, through their own authorities. Put the island question separately before assuming either the restriction or the freedom carries across.

Is a curio counter inside my lodge caught?

The Order names museums and curio shops as closed to non-citizens. Whether a retail counter inside a licensed hotel is a separate curio business turns on how it is licensed and invoiced. Put that to the licensing officer in writing.
