EAC Citizens and Reserved Classes: A Passport Is Not an Exemption This Desk Will Invent

Update, 18 October 2026. We have since read the penalty lines of GN No. 487A of 2025 and published them, with the fifteen reserved activities, in our BRELA fronting checks guide. A non-citizen carrying on a reserved activity faces a fine of not less than TZS 10,000,000 or up to six months' imprisonment, plus revocation of visa and residence permit (para 3(3)(a)). A citizen who assists faces a fine of TZS 5,000,000 or up to three months' imprisonment (para 3(3)(b)). Where this page says it publishes no penalty figure, that statement is superseded. On 3 October 2025 Kenya's Principal Secretary for EAC Affairs said Tanzania had assured Kenya that no Kenyan business would be affected by the Order. We have found no amending notice giving that assurance legal effect, so the Order's text still governs.

Citizenship is not residence is not a licence

An EAC national may have easier immigration routes on some live instruments. Confirm Immigration, do not invent. That is not Tanzanian citizenship for a reserved business class. Wholesale, clearing, on-farm buying and salon/barber as reported still want a citizen controller unless the Gazette or a live EAC instrument this desk has not confirmed says otherwise.

Worked path: Kenyan retailer versus Ugandan factory GM

A Kenyan who wants a Dar supermarket is in the reported wholesale/retail reservation. The EAC passport does not, on anything this desk has confirmed as a primary instrument, turn that person into a Tanzanian citizen for the till. Screen GN 487A. Forming a Tanzanian company with Kenyan control is reported not to cure. Instruct an advocate against the Gazette, not against a Nairobi WhatsApp group.

A Ugandan GM of an open-class factory still needs the live work-permit stack. EAC nationality may change some immigration routes. Confirm Immigration, do not invent. Companies versus humans

An EAC-incorporated company is not a Tanzanian citizen. Look through to controllers. A Kenyan company owned by a third-country fund is not ‘EAC local’. BO filings should match that look-through. Nominees make it worse.

Common-market instruments exist at EAC level. This page will not paraphrase a protocol from memory as a GN 487A carve-out. If you rely on one, print it and put it in the minute. If you cannot print it, you do not have it.

Work, land, tax

Work permits, land instruments, and Union taxes do not collapse because of a Community passport. Mainland versus Zanzibar still splits. ZIPA versus TISEZA still splits. EAC is not a third Union.

On-farm crop buying remains the cashew example on this site. An EAC trader buying at the farm gate is still in the reported reservation until a primary instrument says otherwise.
