Tanzania Double Tax Treaties: Residence Paper, Beneficial Owner, Then the Rate

Direct answer

Tanzania Double Tax Treaties? Tanzania has concluded double-taxation agreements with a live list of partner states. Where a treaty applies, it can reduce withholding or allocate taxing rights. It does not replace a Tanzanian withholding return, a bank documentary pack, or a beneficial-owner test. Residence certificates, limitation-on-benefits language, and TRA’s current claim process are live practice. This page does not reprint the country list or any treaty rate. Confirm the live list and the claim process on tra.go.tz before you model a reduced rate in a term sheet.

This page is the treaty-claim operating file: when a Tanzania double-taxation agreement can change a withholding row, and what TRA will still ask. It is not a country list, not a rate table, and not a substitute for the WHT page.

As at 10 September 2026. Confirm TRA’s live list of agreements in force. This page reprints no partner-state list and no treaty rate. Lists go stale the week after you paste them. A protocol can enter into force without a press conference you saw.

What a treaty changes

Where an agreement applies, it can reduce withholding on dividends, interest or royalties, allocate taxing rights on business profits, or set a permanent-establishment threshold. Those are the usual investor questions. The treaty can also preserve Tanzania’s tax. It is not a coupon.

A treaty does not incorporate the company, does not open a reserved GN 487A class, does not replace a work permit, and does not instruct a bank to skip AML. It is a tax instrument between states, claimed by a taxpayer who qualifies.

Residence, beneficial owner, limitation on benefits

Test (orientation)What TRA commonly wants to seeTypical stall
Residence in the partner stateA residence certificate the live process acceptsA brass-plate letter from a formation agent
Beneficial owner of the incomeWho actually enjoys the dividend or royaltyA treaty SPV with no substance
Limitation on benefits / anti-conduitWhatever the live treaty text saysIgnoring a protocol that narrowed the claim

Those rows are orientation. The treaty you are claiming is the text. Read it. Confirm TRA’s claim process: forms, timing, whether a reduced rate is claimed up front or by refund. This page freezes none of that mechanics.

How not to read Wikipedia

Secondary tables of ‘Tanzania DTA countries’ are discovery. They omit protocols, entry-into-force dates, and terminated instruments. If the parent’s tax slide and TRA’s list disagree, TRA’s list wins. If TRA’s list and the Gazette of the instrument disagree, the instrument wins. Print the instrument.

East African Community overlays and multilateral instruments, where they apply, are further text. Do not assume an EAC citizen is treaty-resident in Tanzania, or that an EAC arrangement replaced a bilateral DTA. Confirm.

Permanent establishment scares

A treaty PE article can decide whether Tanzania taxes a foreign enterprise’s business profits. Construction sites, service PEs and agency PEs are the usual construction and consulting stalls. This page will not invent a day-count. Day-counts live in the treaty you are looking at. A 183-day rumour from another country’s treaty is how you mis-diary a site.

A BRELA subsidiary is not a PE question; it is a resident company. A ‘project office’ with no Tanzanian person and a two-year site is how PE files start. Take advice before the camp is built.

Sequence

  1. Identify the beneficial owner: not the invoice entity if they differ.
  2. Confirm an instrument is in force with that owner’s residence state.
  3. Read the article that matches the income type.
  4. Collect the residence paper TRA currently wants.
  5. File the WHT claim or return on the live process, then instruct the bank.

Where this file stalls

Worked path: Dutch holdco vs operating parent

A Dutch holdco that only holds the Tanzanian shares, with no people and no decisions, is the textbook beneficial-owner fight. Even if a Netherlands to Tanzania instrument exists and is in force (confirm, do not assume from this sentence) the claim can still fail the beneficial-owner or LoB test. Structure with advice, not with a slide.

An operating parent in a treaty state that actually directs the Tanzanian business, with a residence certificate and a dividend resolution, is the ordinary claim. Still file. Still keep the paper with the SWIFT.

Currency of this file

Treaties enter into force, protocols amend them, and TRA practice on certificates moves. This page is orientation as at 10 September 2026. tra.go.tz and the instrument win.

Documents TRA will actually recognise as a claim

The instrument in force; a residence certificate that matches the beneficial owner; the WHT computation at the claimed rate; and the domestic return the live process still wants. A formation agent’s covering letter is not a residence certificate. A tax slide from a 2019 roadshow is not the instrument.

If the beneficial owner and the invoice entity differ, write why. Conduit language is in more than one treaty. Read yours.

What this page will never publish

A list of partner states. A treaty rate. A PE day-count copied from another country’s article. Those belong in the instrument you are claiming, confirmed against TRA’s live list.

Failure modes

Dutch or Mauritian holdcos with no people used as a rate machine. Claiming a treaty that has been protocolled into a narrower article than the one in your memo. Skipping the return because ‘DTA means exempt’. Mixing a TISEZA holiday and a treaty rate as one cell in a model.

As-at 10 September 2026: diary discipline

Confirm TRA’s list the week you sign the SPA or the licence, not the week of first dividend. If a protocol entered into force and you missed it, the protocol wins.

Mandate-holders this file does not replace

TRA is the claim desk. The other state’s tax authority issues the residence paper. The commercial bank still wants a documentary pack. BRELA still wants a real beneficial owner. A treaty does not move those desks into one window.

ZIPA and TISEZA do not grant treaty rates. If an incentive and a treaty both appear in a model, they are two instruments. Confirm each. Do not add the percentages in a cell labelled ‘tax’.

Permanent-establishment questions are TRA plus, often, an immigration overlay: people on the ground without permits are a different breach. See the work-without-permit page. A PE argument does not authorise the engineer to work.

What to put in the board minutes

Write the beneficial owner’s residence state, the instrument you believe is in force, and that TRA’s live list will be printed before first payment. If the owner is a holdco, write why it is the beneficial owner in one paragraph a stranger could understand. If you cannot, expect the claim to fail.

When a protocol is published, minute that someone will read it. Treaties are not a set-and-forget cell in a financial model.

What a declined treaty pack usually looked like

A rate copied from a booklet, a brass-plate residence letter, and a beneficial owner who cannot name a single employee in that state. TRA will not be moved by the booklet. Print the instrument, print TRA’s live list, and collect the residence paper the live process wants. If those three cannot be put on one table, you do not have a claim. You have a hope. Banks will not SWIFT on a hope.

Operator calendar for a treaty claim

Week of structure: identify the beneficial owner, not the invoice entity. Week of first expected dividend: print TRA’s live list and the instrument. Month before payment: residence certificate the live process accepts. Payment week: WHT return then SWIFT. If the certificate arrives after the SWIFT, you have a refund conversation, not a reduced-rate payment. Confirm tra.go.tz. This page still prints no partner list.

Cross-links without contradicting keepers

The WHT page classifies the payment. This page only decides whether a treaty can change the row. The repatriation page builds the bank pack. Beneficial-ownership pages name the people. If a sentence here ever appears to waive WHT because ‘DTA’, ignore that sentence. File the claim. Confirm tra.go.tz. GN 487A hedging on this site is unchanged: reported Order, 28 July 2025, fifteen classes, local incorporation reported not to cure, no penalty figure.

Frequently asked questions

Can you list Tanzania’s tax treaties?

No. Confirm TRA’s live list. A list on this page would go stale.

Does a treaty remove withholding?

It can reduce a rate. It does not skip the claim or the return.

What paper proves residence?

Whatever TRA currently accepts, commonly a certificate from the other state’s tax authority. Confirm the live process.

Is an EAC passport a treaty claim?

No. EAC citizenship is not automatically DTA residence.

Does ZIPA or TISEZA grant treaty rates?

No. Treaties are state-to-state. Incentives are a different instrument.

Where are rates?

In the treaty article and the domestic row, claimed through TRA. Not here as a table.
