Land Rent and Property Rates: The Bills That Follow Occupancy

Who pays land rent and property rates in Tanzania? Land rent is assessed on the ground under the Land Act Cap. 113 by the Commissioner for Lands, and falls on whoever the register shows as holder of the title, annually from 1 July. Property rate is struck on the building by the rating authority under Cap. 290 and collected by TRA as its agent. A lease can recharge both to the occupier; it cannot move either liability off the register. The usual stall is arrears found at the approval desk. Confirm at lands.go.tz and tra.go.tz.
This page is the occupancy-cost operating file: which annual public charges attach to occupied Tanzanian property, who is billed for each, and how a lease recharge survives or fails. It is not a valuation manual and not a rent-review guide.
- Before the plot is bought: investment land due diligence
- Where the receipts live: records that support returns
- Fitting this into quarter one: the 90-day launch plan
- Where the occupier is not a company: NGO, society, trust or guarantee
As at 15 September 2026. Confirm ground-rent bands at lands.go.tz and the rate schedule on tra.go.tz; this file rests on the Land Act Cap. 113 and the Local Government Finance Act Cap. 290.
Two charges, two registers, one occupier
Land rent attaches to the ground: it is assessed on a right of occupancy under Cap. 113, and the debtor is the registered holder. Property rate attaches to what stands on that ground, struck by the urban or district authority under Cap. 290. Neither pauses because the premises are dark, and neither is extinguished by a clause between landlord and tenant.
Test first whether your vehicle may hold the ground. Section 20 of Cap. 113 shuts a non-citizen out of Mainland land except for investment purposes, and a body corporate counts as a citizen only where citizens hold the majority of its shares: incorporation in Dar es Salaam does not cure a foreign shareholder register. GN No. 487A of 2025 separately closes named activities to non-citizens.
What land rent is assessed on
Land rent bears no relation to what a tenant pays a landlord. It is charged on area, shillings per square metre a year, banded by the use endorsed on the title and by the location grade the Ministry assigns. The schedule sits in regulations made under Cap. 113 and is revised by Government Notice, not by a Finance Act. Take the current band from the zonal land office; none is published here.
The bill is raised for the Government year beginning 1 July, issued through the Ministry’s land information system and settled on a control number against the title number. Arrears carry a penalty set by the same regulations and accumulate quietly, because the demand goes to the address the register holds, often one the holder left years ago. Default is also breach of a condition of occupancy, which puts the title into revocation territory.
What property rate is charged on
The rate falls on the building, not the ground beneath it, and the assessment forks on whether the property has been valued. For an unvalued building the charge is flat: TZS 18,000 for an ordinary building and TZS 90,000 for each storey of a storey building, so a four-storey block carries four charges rather than one. Confirm the live schedule on tra.go.tz.
Where the property sits in a valuation roll those flat amounts fall away, and the charge is struck against rateable value at a rate varying with value and location rather than one national percentage. Commercial and industrial stock in the city councils is what has most often been valued. Exemptions under Cap. 290 are narrow and use-specific: a commercial letting inside an otherwise exempt building does not travel under it.
The annual charges on one occupied commercial building
| Charge | Instrument | Who is billed | Who collects | Cycle |
|---|---|---|---|---|
| Land rent | Cap. 113 and regulations | Registered occupier on the title | Ministry of Lands, on a control number | Annual, from 1 July |
| Property rate | Cap. 290 | Owner of the building | TRA, as agent for the rating authority | Annual |
| VAT on rent at 18% | Cap. 148 | Tenant, charged by a registered landlord | TRA, through the landlord’s return | Monthly |
| Withholding tax on rent | Cap. 332 | Deducted by the tenant at 10% resident, 15% non-resident | TRA, remitted by the tenant | Monthly |
| Service levy at 0.3% of turnover | Cap. 290 | The occupying business | The council where it trades | Quarterly |
| Business licence | Business Licensing Act Cap. 208 | The occupying business, per premises | Trade officer for the area | Annual renewal |
A tenant of commercial premises is a withholding agent under Cap. 332: deduct on rent exclusive of VAT, and remit. Failing to deduct leaves the tenant carrying the landlord’s tax, plus interest. Letting commercial premises is a taxable supply, so a registered landlord charges VAT under Cap. 148; a registered tenant recovers it as input tax, an exempt occupier does not. Service levy is paid to the council where the business trades, and the licence is per premises: a second branch is a second renewal.
What the lease says and what the register says
Most commercial leases here put outgoings on the tenant. The clause works commercially and fails administratively, because the payer is not the debtor. Receipts issue in the holder’s name against the holder’s title number, while the tenant keeps a bank slip and the landlord’s invoice. That gap surfaces on a disposition, where the Commissioner wants a clean rent account; on a mortgage, where the lender’s search exposes arrears; and on exit, where a tenant who funded four years of ground charges cannot demand the ledger.
Draft for it. Make the recharge payable against evidence rather than an invoice: the demand note and the stamped receipt each year, produced before the debit is raised. Tie the rate recharge to the storey count or roll entry actually assessed, not to a percentage of rent. Where the landlord holds a derivative right from the investment authority, read that deed: charges the head instrument bears can pass down into your own lease.
The annual cycle, in the order the desks run it
- Search the title and the rent account before signing. Title number, unexpired term, endorsed use, encumbrances, caveats and the arrears line.
- Fix the recharge in the lease. Name each charge, the evidence required, the cap, and who lodges any objection.
- Apply for the Commissioner’s approval. A disposition of a right of occupancy operates only once approved; lodge the prescribed application.
- Stamp inside thirty days, then register. Cap. 189 charges a lease at 1% of the annual rent reserved. Until the registry endorses it, a purchaser of the reversion is not bound by your term.
- Open the July file every year. Check area, use band and the brought-forward line before anyone pays.
- Reconcile the rate. Match the recorded storeys or the roll figure against what the council has actually assessed.
- Run the monthly revenue line. Withhold on rent, remit on time, file the certificate, and claim the landlord’s VAT against input tax.
Papers this file needs
From the land side: a certified copy of the certificate of occupancy or the registered derivative right; the deed plan and survey; the current demand note with the prior year’s receipt; a rent clearance where a disposition is in play; the Commissioner’s approval; and the stamped, registered lease in counterpart.
From the rating and corporate sides: the council’s assessment or valuation roll extract; the recorded storey count; certificate of incorporation, TIN and VAT registration certificate; the board resolution authorising the lease; a current BRELA extract showing shareholders and beneficial owners; and the business licence for these premises.
Illustrative arithmetic, not a quotation
A foreign-controlled operating company takes two floors of a four-storey block in Kinondoni from a resident landlord holding a granted right of occupancy over a surveyed 1,800-square-metre plot. Rent is TZS 15,000,000 a month, exclusive; the building is not in the valuation roll; turnover is TZS 4,000,000,000. Ground rent is assumed at TZS 1,200 per square metre a year: an assumption, not a published band.
- Annual rent reserved: TZS 15,000,000 × 12 = TZS 180,000,000.
- VAT at 18%: TZS 32,400,000, recoverable as input tax if the tenant is registered.
- Withholding at 10% on resident rent: TZS 18,000,000, deducted from the rent rather than added to it.
- Property rate: four storeys × TZS 90,000 = TZS 360,000 a year, billed to the owner.
- Land rent assumed: 1,800 × TZS 1,200 = TZS 2,160,000 annually, recharged to the occupier.
- Service levy: 0.3% × TZS 4,000,000,000 = TZS 12,000,000, to the council.
- Stamp duty on the lease: TZS 1,800,000, once, inside thirty days.
Charges added on top of the rent total TZS 46,920,000, of which TZS 32,400,000 is VAT a registered tenant recovers; the duty is a separate one-off. The withheld TZS 18,000,000 is the landlord’s tax passing through the tenant’s account. Approval, registration, survey, valuation and licence fees sit outside every figure above.
Where this file stalls
- A landlord’s ground charges unpaid since the title issued, surfacing when the tenant applies to sublet.
- A budget built on the flat per-storey charge for a warehouse the council valued years ago.
- Rent paid gross for eighteen months by a tenant who never acted as withholding agent, then assessed for the tax it should have deducted.
- Outgoings recharged monthly on the landlord’s invoice, with no demand note behind any of it.
What moved, and what held
Collection of the rate sits with TRA, acting as agent for the councils under amendments the Finance Acts made to Cap. 290, so the assessing office and the collecting office are different desks; the channel has at points run through prepaid electricity meters rather than a demand note, so ask TRA how the bill will reach these premises. Investment land once allocated through the Tanzania Investment Centre and EPZA now sits with the Tanzania Investment and Special Economic Zones Authority under the 2025 Act; older deeds keep running, new ones issue in the Authority’s name.
Zanzibar bills on its own paper
Unguja and Pemba stand outside all of that. Tenure runs under the Land Tenure Act No. 12 of 1992; land vests in the Government of Zanzibar and the Commission for Lands administers grants, rent and its own registry. Rating is not a Union matter either: it arises under Zanzibar legislation and is collected through the Zanzibar Revenue Authority and the municipal councils, so a Mainland receipt proves nothing on the islands. VAT on an island letting is a ZRA file; income tax stays Union, so withholding on that rent is still remitted to TRA. Island premises are held by companies registered with BPRA.
Mandate-holders this file does not replace
The Commissioner for Lands assesses ground rent and approves dispositions; the Registrar of Titles registers what has been approved. The urban or district authority strikes the rate and maintains the valuation roll; the Chief Government Valuer fixes value. TRA collects the rate as agent and owns withholding, VAT and stamp duty. The council owns service levy, the trade officer owns the licence, and BRELA keeps the shareholding record the citizenship test is read against. Zatra structures the occupancy file and sequences these desks; it does not practise law, value property or issue clearances.
What to confirm before you act
- Title number, registered holder, endorsed use and arrears position, from a fresh search.
- Whether the building is in the valuation roll, answered by the council in writing.
- The recorded storey count against what is standing on the plot.
- The current per-square-metre band for that use and location, from the zonal land office.
- Whether the landlord is VAT-registered, and your own recovery position.
- The landlord’s residence, since 10% and 15% turn on it.
Frequently asked questions
Does an empty building stop the rate?
No. The charge attaches to the building, not to its use or income. Vacancy is no ground for suspension, and arrears run on while the premises stand unlet.
We pay the outgoings: are we the debtor?
No. Ground rent is owed by the registered holder and the rate by the owner. A recharge clause makes you the source of funds, not the party the mandate-holder can clear.
Do we withhold on rent paid to a landlord abroad?
Yes, at 15% rather than the resident 10%. Non-residence is tested on the landlord, not on where the premises sit, and the remittance remains a TRA filing.
What if the landlord’s ground rent is in arrears?
Your application to sublet, assign or mortgage stalls at the approval desk until the account is clean, and persistent default exposes the title to revocation.
Is service levy the same bill as the rate?
No. Both sit under Cap. 290, but the levy is a turnover charge paid to the council where you trade, while the rate is an annual building charge collected by TRA.
Is staff housing treated like the office?
Not for VAT. Residential letting follows its own row, so a lease covering both should split the rents rather than charge one figure across the whole property.
Where is Zatra’s fee for this work?
Only on /pricing/. Ground rent, rates, duty, approval and registration charges are paid on their own control numbers to the mandate-holder, never through this firm.
