Tanzania’s Fertilizer Regulations 2026: What Dealers Must Re-File

What changed for dealers and importers under Tanzania’s fertilizer regulations? The Fertilizer Regulations published as Government Notice No. 68 on 20 February 2026 are a fresh principal set of subsidiary legislation made under the Fertilizers Act, 2009; the Act and the Tanzania Fertilizer Regulatory Authority’s mandate stand unchanged. What a re-made Government Notice moves is the licence classes, the prescribed forms, the fee schedule, the renewal cycle and the offence provisions. TFRA publishes the gazetted text on tfra.go.tz. The usual stall is a dealer quoting a supplier’s circular instead of the commencement, revocation and savings clauses, then renewing on a timetable that no longer exists.
This page is the fertilizer trade operating file: which permission a dealer or importer actually holds, which desk issues it, and what a fresh instrument does to a licence already in the drawer. It is not a clause-by-clause commentary on text you have not read, and not a substitute for the application itself.
- The licence class itself: fertilizer dealer licensing
- Land under a blending plant or store: agricultural land access for foreign investors
- Fake product on the pallet: acting against counterfeits
As at 14 September 2026. Confirm the gazetted text and the current licence classes with TFRA on tfra.go.tz; the instruments beneath this page are the Fertilizers Act, 2009 and the 2026 Fertilizer Regulations.
The mandate sits with TFRA; the Government Notice is subsidiary
The Tanzania Fertilizer Regulatory Authority licenses the trade, registers the product and inspects the store under the Fertilizers Act of 2009. The Minister responsible for agriculture makes regulations; the Authority applies them. What appeared on 20 February 2026 is a principal set, not an amendment set, so it carries its own commencement, its own revocation and its own schedules. The parent Act did not move. Your class, your renewal date and the paper you file on can all have moved beneath it.
Agriculture is not a Union matter. TFRA’s writ runs on the Mainland. Cargo landed at Malindi, or a counter trading in Unguja, answers to the Revolutionary Government’s agriculture ministry and to the Zanzibar Revenue Authority. A product entered in the Mainland register is not thereby registered on the islands, and a company incorporated at BPRA runs its own licence diary.
Read the gazetted text before you quote what changed
TFRA publishes the Government Notice on its own site. Five provisions decide whether your file needs work, and they are read in this order before anything else in the instrument.
- Citation and commencement: whether the set bites from publication or from a day the Minister appoints later.
- Revocation: which earlier subsidiary legislation dies, and therefore which of your approvals now rests on a dead instrument.
- Savings and transitional: whether a licence granted under the revoked text runs to its own expiry, or must be re-filed inside a stated window.
- The Schedules: prescribed forms and fee lines. A re-made instrument usually moves money and paperwork here rather than in the body.
- Offences and penalties: what is now punishable, at whose hand, and what may be compounded.
A law-firm alert is discovery; the Gazette is the instrument. Where a supplier’s circular and the published text disagree, the published text wins, and the inspector standing in your warehouse is reading the second.
Ownership before process: the reserved list and the land gate
Settle who may own the counter before anyone drafts an application. Government Notice No. 487A of 2025 carries the activities reserved or restricted for non-citizens, and small-scale retail trade sits close to that boundary: an agro-dealer shop is retail. Importing and wholesaling into citizen-owned retail is a different structure from owning the shops. Read the current list against the intended shareholding before the memorandum is signed.
Land is the second gate. A non-citizen does not hold land for agricultural purposes on the terms available to a citizen; investment land reaches a foreign-owned company as a derivative right arranged through the Tanzania Investment Centre under the Land Act. A blending plant or regional depot is therefore a land file before it is a TFRA file.
Three permissions, and which one the trade needs
A dealer licence, a registered premises and a registered fertilizer are three different things. The licence attaches to the person and the class of trade; the premises entry to the address an inspector will visit; registration to the formulation itself, which then enters the Authority’s register. An unregistered formulation does not become lawful because the importer holds a valid licence.
| Activity | Desk that decides | What the file is | Where it stalls |
|---|---|---|---|
| Importing a formulation already registered | TFRA, then TRA at entry | Dealer licence in the importing class plus the consignment’s entry pack | A class that covers wholesale but not import |
| Bringing in a formulation not yet registered | TFRA | Product registration on its own application and analysis, ahead of any order | Fixing the vessel before the register entry |
| Blending or manufacturing locally | TFRA, with premises inspection | Manufacturer or blender class, approved plant and store, land and workplace files | Treating a blending plant as a warehouse |
| Wholesale into regional depots | TFRA | Wholesale class with every depot named on the premises entry | A second depot opened and never added |
| Retail from an agro-dealer counter | TFRA plus the council | Retail class and the council business licence for that address | Ownership that crosses the reserved-list boundary |
| Importing for an estate’s own use | TFRA and TRA | Confirm whether own-use import still requires a dealer class | Assuming own consumption sits outside the Act |
The order the desks take it
- Fix the shareholding and the site: reserved-list check, land route, lease or derivative right.
- Incorporate and register for tax: BRELA certificate and memorandum, TIN, council business licence.
- Read commencement, revocation and savings in the 2026 Government Notice against any approval you already hold.
- Apply to TFRA in the correct class, on the form the current Schedule prescribes, with the fee line taken from that Schedule.
- Register the formulation unless it already appears in the Authority’s register under a name you can evidence.
- Clear the technical desks before the vessel sails: standards, plant health for material of plant or animal origin, chemicals and explosives for ammonium-nitrate products.
- Enter the cargo and open the store: customs entry, verified bagging, inspection at the depot.
- Diarise renewal and inspection on the timetable the 2026 Schedule sets, not the one used last season.
What goes into the application pack
Certificate of incorporation and memorandum from BRELA; TIN, with the VAT registration where turnover has crossed the threshold; the council business licence for the exact address; proof of premises as a lease or title, with a store an inspector can walk through; credentials for the technical person the Act expects to stand over storage and handling; laboratory analysis carrying the guaranteed nutrient content you intend to print; the label and bag artwork; and the current application form with its receipt. Fee lines belong to the Schedule, not to a table circulated on WhatsApp.
The import lane: customs, standards and the chemical desks
A TFRA licence does not clear cargo. The entry is lodged with TRA customs on the Tanzania Customs Integrated System, and the classification chosen there decides the duty line and every exemption riding on it. The Tanzania Bureau of Standards owns the specification and the conformity evidence accepted at import; confirm whether the tariff line falls inside the pre-shipment verification programme before loading, because that certificate cannot be issued after sailing.
Two desks surprise importers. Fertilizer of plant or animal origin meets the plant-health regime: an import permit and an exporting country’s phytosanitary certificate, administered by the Tanzania Plant Health and Pesticides Authority. Ammonium-nitrate-bearing products meet the explosives and industrial-chemicals regime, owned by the Chief Inspector of Explosives and the Government Chemist Laboratory Authority; a fertilizer permission substitutes for neither. Net content and bagging answer to the Weights and Measures Act, Cap. 340, and a short bag is the easiest case an inspectorate brings.
For bulk consignments, shipping-agency arrangements run through the Tanzania Shipping Agencies Corporation. Confirm whether the cargo class falls inside its exclusive agency before appointing anyone.
What VAT exemption does to a fertilizer importer
Fertilizer supplies sit in the exemption schedule to the Value Added Tax Act, Cap. 148. Confirm the live schedule on tra.go.tz. Exemption is not zero-rating. A zero-rated supplier charges nothing and still recovers the tax on its costs; an exempt supplier charges nothing and recovers nothing. Every 18% paid on port handling, inland haulage, warehousing and bagging stays in the cost of the bag.
On the duty line, fertilizer tariff lines have carried a 0% rate under the East African Community Common External Tariff. Confirm the live rate with TRA against the actual HS code: the tariff is amended annually, and blends do not always classify where a buyer assumes they will.
Illustrative arithmetic on one urea consignment
Illustrative arithmetic, not a quotation. Take 2,000 tonnes landing at TZS 1,300,000 a tonne after freight, clearing and duty at the zero line: TZS 2,600,000,000. Packed at 50 kg, that is 40,000 bags at TZS 65,000 each.
Suppose TZS 120,000,000 of that spend is Tanzanian taxable services: handling, haulage, storage. VAT at 18% adds TZS 21,600,000, and because the onward supply is exempt none of it returns. Spread across the same 40,000 bags it is TZS 540 a bag, lifting the cost to TZS 65,540 before margin, shrinkage or working capital. An importer modelling that consignment on recoverable input tax finds the hole at the year-end reconciliation, not at the quayside.
Bulk procurement, indicative prices and the subsidy lane
Two public mechanisms sit beside the private import lane. Bulk procurement concentrates ordering of the main straight products through a tendered arrangement administered by TFRA, and the Authority publishes indicative prices for what the arrangement covers. The Ministry of Agriculture’s subsidy programme reaches growers through registered agro-dealers and a registered-farmer database, settled on the programme’s own system.
Both are entered by registration, not by negotiation. A dealer outside the registered list can hold a perfectly valid licence and still sit outside the subsidised volume: which, in a good season, is most of what moves. Ask TFRA which products fall inside the arrangement in the current window before building a private plan on top of them.
Where this file stalls
- A licence renewed on the old cycle after a re-made instrument reset the Schedule.
- A second depot opened against a premises entry that names only the first.
- A vessel fixed while the formulation was still outside the register.
- Ammonium-nitrate cargo booked with nothing from the explosives side.
- Bags printed with a nutrient claim the analysis certificate does not support.
- A Mainland document produced at an island inspection.
- Input tax modelled as recoverable along an exempt supply chain.
Mandate-holders this page does not replace
TFRA licenses dealers, registers formulations and inspects stores. TRA owns the customs entry and the tax position. TBS owns the specification. TPHPA owns plant health. The Government Chemist Laboratory Authority and the Chief Inspector of Explosives own the chemical and explosive permissions. The Weights and Measures Agency owns net content. The council owns the business licence for the address. OSHA owns the plant. Zanzibar’s agriculture ministry and ZRA own the islands. Zatra prepares, structures and coordinates a file across those desks; it does not issue a licence, register a product or clear a consignment, and no approval is guaranteed.
What to confirm before you act
- The transitional provision, read against the licence you hold today.
- The class your actual trade needs, and whether it covers import as well as sale.
- Whether the formulation appears in the register of registered fertilizers, and in whose name.
- The prescribed forms and fee lines, taken from the Schedule rather than a circular.
- The HS code, the live tariff rate and the VAT position on tra.go.tz.
- Whether the shareholding clears GN No. 487A of 2025, and whether the site needs a TISEZA derivative right.
- Which side of the Union the counter actually stands on.
Frequently asked questions
Does Government Notice No. 68 replace the Fertilizers Act?
No. It is subsidiary legislation made under the Act. The Act carries the Authority’s mandate and the offence framework; the regulations carry classes, forms, fees, timetables and procedure. A dealer reads both.
Is my existing dealer licence still valid?
That is answered by the savings and transitional provision, which differs between a set running licences to their own expiry and one requiring re-filing inside a stated window. Read that provision in the gazetted text.
Does a dealer licence let me sell any fertilizer?
No. The formulation must itself be registered. The licence concerns you and your class of trade; registration concerns the product, its guaranteed nutrient content and its label.
Do I need TFRA for fertilizer imported only for my own estate?
Confirm with TFRA. Own consumption is not automatically outside the Act, and the customs entry still asks what the goods are and who holds the permission covering them.
Does a Mainland licence cover Zanzibar?
No. Agriculture is a non-Union matter, so the islands license and tax through their own ministry and the Zanzibar Revenue Authority. Trading both sides means two files and two diaries.
Can I recover the VAT on clearing and haulage bills?
Not where the onward supply is exempt. Exemption blocks the input credit, so the 18% under the VAT Act, Cap. 148 stays in the bag price. The exemption schedule moves in Finance Acts; check TRA’s current version.
What does Zatra charge for this work?
Professional fees appear only on /pricing/. Government, regulator, laboratory and port charges are separate lines and are never invoiced as ours.
