Zanzibar Tourism Licensing: The Four Layers Before the First Guest

Direct answer

Zanzibar tourism licensing: which desk, and in what order? Tourism is not a Union matter, so the Zanzibar Commission for Tourism, not the Mainland’s Tourist Agents Licensing Authority, issues the class that lets you take a paying guest on the islands. Four layers carry it: the legal person at BPRA, investment status and the land route through ZIPA, the Commission’s class and grading, then ZRA and TRA registration. Restriction bites before process: a non-citizen cannot hold island land, and participation conditions attach to some classes. Confirm the live class schedule on zanzibartourism.go.tz before promising a shareholding.

This page is the Zanzibar tourism licensing operating file: which desk grants what on Unguja and Pemba, in what sequence, and where shareholding decides the answer. It is not a Mainland TALA manual and not a fee schedule.

As at 15 September 2026. The mandate-holder is the Zanzibar Commission for Tourism (zanzibartourism.go.tz); this file rests on its licensing Act, the Zanzibar Investment Promotion and Protection Act No. 14 of 2018, and the islands’ own land and company statutes.

Tourism sits outside the Union list

The Constitution of the United Republic of Tanzania, 1977 sets out Union matters in its First Schedule. Tourism licensing is not there. Zanzibar legislates its own regime, grants its own classes and keeps the revenue.

So the Tourism Act No. 29 of 2008 and the Tourist Agents Licensing Authority it created have no reach across the water. A TALA licence held in Dar es Salaam authorises no excursion out of Nungwi, and an island class covers Unguja and Pemba but no Serengeti leg. Beach-and-bush is two licensing files and should be priced as two.

What does cross the water is whatever the Constitution made Union: income tax, customs, immigration and currency.

What the islands close before they open anything

Three restrictions bite on a tourism file, each at a different desk.

Land is the hardest. Under the Land Tenure Act No. 12 of 1992 all land in Zanzibar is public land vested in the President, and a non-citizen does not acquire it. A foreign investor takes a leasehold interest routed through the Zanzibar Investment Promotion Authority and the Commission for Lands, for the term those desks will sign. Without it there is no accommodation class: the Commission does not grade premises you cannot show title to.

Ownership is second. The ZIPA regime sets which projects need an investment certificate and on what terms, and the small-scale island trades (guiding, tourist transfers, beach vending, curio retail) are held for Zanzibaris in practice. Read the conditions published against each class before drafting a memorandum of association, not after.

Fronting is third. A local name on a register that conceals foreign control is what these desks look hardest at. Nor is a Mainland instrument an island one: GN No. 487A of 2025 reserves activities under Mainland business-licensing law and is the wrong paper at a Vuga counter.

A BPRA certificate proves a company exists; it says nothing about whether that company may sell a dive.

Classes are granted by activity, not by ambition

Accommodation, tour operation, travel agency, water sports and diving, tourist transport, guiding and tourist-facing catering each sit in a separate class, and accommodation is additionally graded. The application asks what you will sell; the class granted is the ceiling on what you may sell.

That ceiling catches hotels. A property licensed for accommodation that also runs spice tours, dhow cruises and airport transfers is trading three classes on one licence. Either the extra activities go onto the file, or they are bought from a separately licensed operator and invoiced that way. Inspectors read booking sheets.

A hull and a kitchen are separate files

Three neighbouring desks refuse more island tourism projects than the Commission does. A dhow, dive boat or transfer craft is registered, surveyed and certificated by the Zanzibar Maritime Authority; an unregistered hull does not become lawful because its owner holds a water-sports class.

A new wing, a jetty or a pool near the high-water mark goes to the Zanzibar Environment Management Authority for an impact assessment certificate or a written exemption, alongside the building permit. Kitchens and food handlers are cleared by the Zanzibar Food and Drugs Agency, with fire safety signed off on the same round. Liquor carries its own island permit.

The order the desks actually take it

  1. Fix the activity list and the class against the Commission’s live schedule, in writing, before anything is drafted.
  2. Settle shareholding and the reserved question with ZIPA and the Commission before a deposit moves.
  3. Register the legal person at BPRA: incorporation, or registration of a Mainland company as an island branch.
  4. Open the ZIPA file where an investment certificate is needed, and carry the lease through to registration at the Commission for Lands.
  5. Clear the neighbours: environmental certificate, building permit, hull registration, kitchen and fire clearance.
  6. Apply for the class, then hold the premises open for inspection and grading.
  7. Register for revenue: TIN with TRA, taxpayer registration and fiscal receipting at ZRA, employer registration at the island social security fund.
  8. Diary renewal and the grading review the week the licence issues, not the month it expires.

The papers the file is built from

Assemble before the first counter visit: certified BPRA certificate of incorporation or branch registration with the memorandum and articles; certified passport or Zanzibar identity copies, CVs and photographs for every director and shareholder; the shareholder register; the registered lease or a certified tenancy agreement over the exact premises, with a site plan; the building permit for anything constructed; the environmental certificate or exemption for coastal works; registration and survey papers for each vessel; health certificates for the kitchen and every food handler; fire clearance; the ZIPA certificate where held; TIN and island taxpayer registration; a bank reference; and the written activity list matching the class sought.

Two items go missing on first submission: the registered lease, because the deposit was paid against an unregistered agreement, and the activity list, because nobody wrote one.

ZRA collects one set of taxes, TRA another

Zanzibar’s tourism charges (the hotel and restaurant levies, the per-night infrastructure tax and the islands’ own value added tax) are administered by the Zanzibar Revenue Authority. The VAT Act Cap. 148 standard rate of 18% does not sit on an island guest bill, and the 0.3% service levy under the Local Government Finance Act Cap. 290 has no island equivalent. Take live rates from zra.go.tz rather than carrying a Dar es Salaam budget across. The island revenue desk runs its own fiscal devices, and a machine issued for Mainland use produces no valid Zanzibar receipt.

Income tax is Union. An island hotel files corporate income tax under the Income Tax Act Cap. 332 with TRA at 30%, pays provisional instalments on the last day of the third, sixth, ninth and twelfth months of its accounting period, and operates PAYE through TRA. Social security is not Union: island staff belong to the Zanzibar Social Security Fund, not NSSF. Customs on imported furniture, vehicles and dive equipment runs through TRA Customs. Where a Finance Act may have moved a row, confirm the live schedule on tra.go.tz.

Illustrative arithmetic: fourteen rooms on the east coast

Illustrative arithmetic, not a quotation. A fourteen-room property offers 14 × 365 = 5,110 room-nights a year. At 60% occupancy that is 3,066 sold room-nights; at an average TZS 180,000 per room-night, accommodation revenue is TZS 551,880,000.

Island charges sit on top of that guest bill: collected from the guest and remitted onward, they are a cash-timing and receipting obligation, not a margin cost.

On a chargeable profit of TZS 90,000,000 after allowable deductions, corporate income tax at 30% is TZS 27,000,000, payable as four provisional instalments of TZS 6,750,000 and trued up on the final return. Budgeting a Mainland service levy on that turnover would provide TZS 1,655,640 for a charge the islands do not raise, and nothing for the ones they do.

Where this file stalls

What moved between 2024 and 2026

Since 1 October 2024 inbound visitors must hold the islands’ own travel insurance, placed through the Zanzibar Insurance Corporation and covering up to 92 consecutive days from entry, bought on visitzanzibar.go.tz. Operators are asked for proof, so it belongs on the rate sheet and in the booking terms. Confirm the live premium and its exemptions there before publishing rates.

The island revenue desk was reconstituted as the Zanzibar Revenue Authority, replacing the former Zanzibar Revenue Board; older correspondence still names the Board. Enforcement against proxy ownership has tightened. On the Mainland side, GN No. 487A of 2025 reset the reserved-activity list for a beach-and-bush operator’s Mainland leg, not for the island class.

Mandate-holders this file does not replace

The Commission owns the class and the grading. BPRA owns the register. ZIPA owns investment status and the route to a lease; the Commission for Lands owns the land instrument itself. The environment authority owns the impact certificate, the maritime authority owns hulls, the food and drugs agency owns kitchens and handlers. ZRA owns island revenue and fiscal receipting; TRA owns income tax, PAYE and customs as Union functions. The Immigration Department issues residence under the Immigration Act Cap. 54, a Union matter, while a non-citizen employee’s work permit is an island labour matter: two applications, not one.

Membership of an operators’ or investors’ association carries no licensing weight. Zatra prepares, structures and coordinates across these desks; it does not practise law, audit, or issue any approval, and no outcome is guaranteed.

Frequently asked questions

Does a Mainland TALA licence let me operate in Zanzibar?

No. Tourism is a non-Union matter, so TALA and the Mainland tourism statute stop at the water. Island activity needs a class from the Zanzibar Commission for Tourism; a combined itinerary needs both files.

Can I use my BRELA company for an island hotel?

Not on its own. It must appear on the Zanzibar register, normally as a branch registered at BPRA. The Commission grades premises held by a person it can see on that register.

Which tourism activities are held for Zanzibaris?

Guiding, tourist transfers, beach vending and curio retail are the trades most consistently reserved in practice, and conditions can attach elsewhere. Read the published class schedule before fixing a cap table.

Does GN No. 487A of 2025 apply on the islands?

No. It is a Mainland instrument made under Mainland business-licensing law. It governs the Mainland leg of an operation and carries no weight at an island tourism counter.

Can a non-citizen own beachfront land for a hotel?

No. Under the Land Tenure Act every parcel in Zanzibar is public land. Foreign investors hold a lease granted through the investment and lands desks, for whatever term those desks approve.

Do island guest bills carry the 18% Mainland VAT rate?

No. That rate belongs to the VAT Act Cap. 148. Zanzibar’s value added tax, hotel and restaurant levies and infrastructure tax are set and collected on the islands by ZRA. Confirm them on zra.go.tz.

Do Zanzibar staff go to NSSF?

No. Social security is not a Union function for island employment; employees are registered with the island fund instead. PAYE and corporate income tax still run to TRA under Cap. 332.
