A company name is not a trademark

Incorporating Sunrise Soap Limited at BRELA gives you a legal person. It does not give you exclusive use of SUNRISE on a shelf. A business licence does not either. TBS product registration does not either. File the mark in the Nice classes you actually use.

Using a mark while the application sits is a risk conversation, not a permission. Confirm live use-and-filing practice. Do not print 50,000 labels on the strength of a company extract.

Worked path: local brand versus group brand

A Tanzanian company launching a soap brand should search, file the classes it will actually sell, and then print packaging. Printing first is how you meet an opposition with 50,000 labels in a warehouse. Company name Sunrise Soap Ltd is not the mark SUNRISE. File the mark.

A foreign group that already owns the mark abroad should still ask whether Tanzania is covered: local filing, Madrid designation, ARIPO, or a gap. Do not assume Kenya coverage includes Dar. Record who may use the mark in Tanzania. A parent owner and a subsidiary user without a story is a later assignment fight.

Zanzibar and Mainland

Selling in Unguja is a second-register question until you confirm otherwise. A Mainland certificate waved at a Zanzibar supermarket is the wrong paper. The Zanzibar trademark slug remains pruned unless upgraded; the distinction stands. Budget a second filing if you sell on both sides.

Enforcement without a frozen playbook

Counterfeit and passing-off sit with Fair Competition, police, TBS and the courts depending on the facts. Acting-against-counterfeits remains a sibling slug. A trademark certificate is not a raid by itself. Instruct an advocate. Zatra is not counsel.

Licensing a distributor should mention the mark. Silence is how the distributor files ‘your’ mark in their own name.
